Chapter 1 General provisions
Article 1 Purpose
The purpose of these terms is to set out the conditions and procedures for using the services provided by D-day Dental Clinic and other necessary matters, together with the rights, meaning and responsibilities of D-day Dental Clinic and the user.
Article 2 Effect and amendment of these terms
- (1) These terms take effect by being made public to users.
- (2) D-day Dental Clinic may amend these terms where circumstances change or where there is an important business reason, and the amended terms take effect in the same manner as in the preceding paragraph.
Article 3 Rules outside these terms
Where a matter not specified in these terms is provided for in the relevant statutes, those provisions apply.
Chapter 2 Membership registration and use of the service
Article 1 Definition of a member
A member means an individual whom D-day Dental Clinic recognizes as suitable for membership, who has agreed to these terms, completed the membership registration form for the service and been issued an "ID" and a "password".
Article 2 Formation of service registration
- (1) Registration for the service is formed by D-day Dental Clinic accepting the user's application and by the user agreeing to these terms.
- (2) An applicant who wishes to register as a member and use the service must provide the personal details requested by D-day Dental Clinic.
- (3) Where D-day Dental Clinic accepts a user's application for registration, D-day Dental Clinic notifies the user of the member ID and of any other matter D-day Dental Clinic considers necessary.
- (4) The ID entered at registration cannot be changed, and only one ID is issued per person.
- (5) D-day Dental Clinic does not accept an application for registration that falls under any of the following.
- a. Where the application is made using another person's name
- b. Where the application is not made under the applicant's real name
- c. Where the contents of the application form are entered falsely
- d. Where the application is made for the purpose of harming public peace and order or public morals
Article 3 Use of the service and restrictions
- (1) As a rule the service is available 24 hours a day, every day of the year, unless there is a particular operational or technical obstacle for the company.
- (2) The service hours in the preceding paragraph may be restricted, after prior notice to members, where D-day Dental Clinic needs to do so, for example for regular system maintenance.
- (3) Within the service, online consultation may not be available 24 hours a day, depending on the personal circumstances of the specialist doctor who answers.
Article 4 Service fees
- (1) The service is available free of charge to everyone registered as a member.
- (2) Where D-day Dental Clinic makes the service chargeable, it must announce the timing, policy and cost of the change within the service before the charges are introduced.
Chapter 3 Withdrawal from the service, re-registration and restrictions on use
Article 1 Withdrawal from the service
- (1) A member who wishes to withdraw from the service must request termination from the operator in person by electronic mail.
- (2) If, when applying to withdraw, you give the name, ID, telephone number and reason for termination by which you can be identified, we check that these match the registration record and then terminate the registration.
- (3) Withdrawal has taken effect when you can no longer log in with your existing ID and password.
Article 2 Re-registration for the service
- (1) Where a user who has withdrawn from the service under Article 1 wishes to register again, the member may request re-registration from the operator in person by electronic mail.
- (2) Re-registration is processed once you give the name, ID and telephone number by which you can be identified.
- (3) Re-registration has taken effect when you can log in with your existing ID and password.
Article 3 Restrictions on the use of the service
Where a member has carried out an act falling under any of the following, D-day Dental Clinic may terminate the use agreement without prior notice or suspend the use of the service for a fixed period.
- a. Where it is contrary to public order and public morals
- b. Where it is connected with criminal activity
- c. Where use of the service is planned or carried out for the purpose of harming the national interest or the public interest
- d. Where another person's ID and password have been misappropriated
- e. Where it damages the reputation of another person or causes them a disadvantage
- f. Where the same user has registered twice under a different ID
- g. Where it harms the service or otherwise impairs its sound use
- h. Where it otherwise breaches the relevant statutes or the conditions of use set by D-day Dental Clinic
Chapter 4 Limitation of liability for the service
Article 1 Online consultation
- (1) D-day Dental Clinic makes every effort to maintain security so that the contents of consultations by members or users of the service are not disclosed to any third party other than the consulting doctor and the service administrator. However, D-day Dental Clinic bears no responsibility for the disclosure or loss of consultation contents in the following cases.
- a. Where the password is leaked through the carelessness of the user and the consultation contents are disclosed
- b. Where the user has deleted the consultation using the "delete" function
- c. Where the consultation contents are disclosed or lost due to a natural disaster or any other situation beyond the control of D-day Dental Clinic
- (2) In order to give a comprehensive and appropriate answer to a consultation requested by a member, the attending doctor and specialist doctors of each department may refer to the consultation contents and the answers.
- (3) The contents of consultations carried out within the service may be used for the following purposes after personal details have been removed.
- a. Academic activity
- b. Authoring activity such as printed matter and CD-ROMs
- c. Part of the service content, such as FAQs and recommended consultations
- (4) An answer to a consultation is a subjective answer based on the medical knowledge of the individual specialist doctor and does not represent the service opinion of D-day Dental Clinic.
- (5) Where a consultation of the following kind is requested, the online consultation may not be provided in whole or in part.
- a. Where the same consultation is requested repeatedly
- b. Where the consultation is requested using expressions contrary to common sense
- c. Where the consultation requests a diagnosis by name
- d. Where the consultation is requested about treatment fees, examination fees, medicine prices and the like
Article 2 Information services
- (1) The content provided in the service is outline and general content and is provided for information only. The information or consultation provided in the service can never take the place of a medical diagnosis. The information or consultation provided in the service is in no way intended to replace medical diagnosis, examination or treatment. If you have a question or a concern about your state of health, you should see an actual specialist doctor and obtain a diagnosis. Under no circumstances should you disregard a doctor's diagnosis, or delay being diagnosed, examined or treated, because of information provided in the service.
- (2) D-day Dental Clinic does not recommend any particular examination, product or treatment method mentioned in the service. All opinions expressed in the service are the opinions of the consulting doctor concerned. D-day Dental Clinic accepts no responsibility for the contents of any document or consultation provided in the service.
- (3) Whether to accept the information in this service, or the opinions of the specialist doctors taking part in the service or of other members and visitors using the service, is entirely a matter for the user's own judgment. D-day Dental Clinic therefore accepts no responsibility for any damage, injury or other disadvantage arising from the use of any product, information, idea or instruction provided to a member.
Chapter 5 Obligations
Article 1 Obligations of the company
- (1) Unless there are special circumstances, D-day Dental Clinic enables members to use the service.
- (2) D-day Dental Clinic has an obligation to provide the service continuously and stably as set out in these terms.
- (3) D-day Dental Clinic handles opinions raised by members through the prescribed procedure by way of an appropriate procedure, and where handling will take a certain period of time it must inform the member of the reason and of the handling schedule.
Article 2 Obligation to keep member information secure
- (1) All responsibility for managing a member's ID and password rests with the member.
- (2) The member agrees to receive service e-mail sent as part of the service.
- (3) Where their own ID has been used improperly, the member must notify D-day Dental Clinic of that fact.
- (4) D-day Dental Clinic does not sell or provide personally identifiable information to any third party unconnected with D-day Dental Clinic without the prior permission of the member or user. However, D-day Dental Clinic may use voluntarily provided registered information in the following cases.
- a. Where information needed to develop new functions, information and services useful to members is provided to developers
- b. Where statistical information about the service's members and user group (which never reveals the identity of an individual member) is provided to advertisers
- c. Where the company uses it in order to run advertising or services matched to the preferences of members and users
- (5) Personally identifiable information (user name, ID, e-mail address and so on) may be disclosed voluntarily in communication spaces such as boards (hereinafter, communication spaces). In such a case the disclosed information may be collected, linked and used by third parties, and you may receive unwanted messages from third parties. Such acts by third parties are beyond the control of D-day Dental Clinic. D-day Dental Clinic therefore gives no assurance about the possibility that member information may be discovered by means beyond the control of D-day Dental Clinic.
- (6) D-day Dental Clinic may use cookie technology to make the service easier to use. A cookie is a small text file used by a website to recognize a returning user and to help provide that user with continued access and a personalized service. In general, a cookie works by assigning the user a unique number that has no meaning outside the site that issued it. A cookie does not enter the user's system and is not dangerous to the user's files. D-day Dental Clinic cannot prevent advertisers on the service or related third parties from using cookies. A member or user who does not want information collected using cookies can control whether to accept cookies in their web browser. However, the use of cookies may be necessary for the service (in particular, personalized information) to work properly.
- (7) D-day Dental Clinic may provide and use member information between the service or the company and its business partners.
Chapter 6 Dispute resolution
- (1) Disputes over matters relating to the use of the service that arise other than as provided in these terms of use shall be resolved by agreement between the parties as far as possible.
- (2) Where litigation is brought over a dispute arising from the use of the service, the court having jurisdiction over the location of the company shall be the competent court.
